These Website Terms of Use ("Terms") govern your access to and use of aetrust.com and any other public website that American Estate & Trust, Inc., a Nevada-chartered trust company, 6900 Westcliff Dr., Ste. 603, Las Vegas, NV 89145 ("AET," "we," "us"), operates and that links to these Terms (the "Website"). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Scope; the Platform. These Terms apply only to the public Website. Access to the Customer Portal, Business Portal, and API (the "Platform") is governed by AET's End User License Agreement and, for accountholders, the applicable account agreement. If these Terms conflict with the End User License Agreement, the End User License Agreement controls on use of the Platform.

2. About AET. AET is a Nevada-chartered trust company subject to supervision by the Nevada Financial Institutions Division and acts as a directed custodian, trustee, and administrator. AET does not sell, recommend, evaluate, or monitor investments, and does not act as an investment adviser, broker-dealer, or fiduciary for investment purposes.

3. Information only; no advice. Website content is for general information and education only and is not investment, legal, tax, or accounting advice. Any fiduciary duties owed by AET arise solely under the terms of the executed trust or account agreements; nothing on this site, and no use of or reliance on its content, creates a trustee, fiduciary, advisory, or client relationship. Trust, custody, and administrative services are provided subject to the terms of the applicable account agreements and governing documents. Tax rules for IRAs, HSAs, Coverdell ESAs, and qualified plans change often and depend on individual facts. You should consult your own advisors before acting on any information on the Website.

4. No offer or solicitation. Nothing on the Website is an offer to sell, or a solicitation of an offer to buy, any security or investment, or an offer of services in any jurisdiction where the offer would be unlawful. Account opening is subject to AET's acceptance, including identity verification and any other review required by law or AET policy.

5. No endorsement of investments or third parties. References on the Website to any investment, investment sponsor, asset class, service provider, or B2B partner are not an endorsement, recommendation, or verification by AET. AET does not evaluate or monitor the merits, legality, or suitability of investments its accountholders direct. You are solely responsible for evaluating the risks, suitability, and merits of any investment and any person offering it.

6. Third-party links. Any links to third-party websites are provided for convenience only and do not constitute endorsement. AET does not control and is not responsible for their content, security, or practices. Your use of them is at your own risk and is governed by their terms.

7. Accuracy. AET tries to keep Website content accurate and current but does not guarantee that it is complete, accurate, or up to date. AET may change or remove content at any time without notice and has no obligation to update it.

8. Permitted use. You may view, download, and print Website content for your personal, non-commercial use, provided you keep all copyright and other notices. You will not: (a) copy, modify, distribute, or create derivative works from Website content except as this Section allows; (b) scrape, crawl, or use automated means to access the Website, other than search engine indexing that complies with AET's robots.txt instructions; (c) frame or mirror the Website; (d) probe, scan, or test the vulnerability of the Website, or interfere with its operation; (e) introduce spyware or malware of any kind; (f) impersonate AET, or state or imply that AET endorses you or any product or service; or (g) use the Website in violation of law.

9. Intellectual property. AET and its licensors own the Website and its content. AET's name, logos, and marks may not be used without AET's prior written consent. No rights are granted except those expressly stated in these Terms.

10. Information you submit. Do not submit Social Security numbers, account numbers, passwords, or other sensitive information through public Website forms, chat, or general email. Messages sent through the Website are not account instructions, and AET will not act on them as instructions; account instructions must be submitted as the applicable account agreement provides. If you send suggestions or feedback, AET may use them without obligation to you.

11. Privacy and cookies. AET collects and uses information from Website visitors as described in its Online Privacy Policy (available at https://www.aetrust.com/privacy-policy/), which also describes AET's use of cookies. AET's customers are also covered by AET's Privacy Notice under the Gramm-Leach-Bliley Act.

12. Fraud and impersonation. AET will never ask for your password or multi-factor authentication code by email, text message, or phone. If you receive a suspicious communication claiming to be from AET, or find a website or profile impersonating AET, report it to [email protected] or 1-866-654-6111.

13. Disclaimer. THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

14. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, AET IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR INVESTMENT LOSSES, ARISING FROM YOUR USE OF OR RELIANCE ON THE WEBSITE. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Accessibility. AET wants the Website to be accessible to everyone. If you have difficulty accessing any content, contact [email protected] or 1-866-654-6111, and AET will work to provide the information in another way.

16. Governing law and venue. These Terms are governed by Nevada law, without regard to conflict-of-law rules, and by applicable federal law. Any dispute arising from these Terms or the Website will be resolved exclusively in the state or federal courts located in Clark County, Nevada.

17. Changes. AET may update these Terms by posting the updated version on the Website. Changes take effect when posted. The "Last updated" date below shows when these Terms last changed.

18. General. If any provision of these Terms is held invalid, illegal, or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in effect. No delay or failure in exercising any right is a waiver of that right. Headings are for convenience of reference only and have no legal effect. These Terms are the entire agreement between you and AET on use of the Website. For accountholders and B2B partners, the End User License Agreement, the applicable account agreement, and any partner agreement also apply to their respective subjects.

19. Contact. Questions about these Terms: [email protected], 1-866-654-6111, or 6900 Westcliff Dr., Ste. 603, Las Vegas, NV 89145, Attn: Compliance Dept.
